European Custom Law

The Customs Union is one the bases of the European Union and an essential element in the functioning of the unified market. The unified market can only function when there is a common application of common rules at its external borders. This implies that the 27 Customs administrations of the EU must act, as they were one. These common rules go beyond the Customs Union as such, and extend to all aspects of trade policy, such as preferential trade, health, environmental control, the protection of EU economic interests and the management of external relations. The creation of a customs union in the European Economic Community in 1968 was implemented internally through the abolition of customs duties, quantitative restrictions and measures having equivalent effect between Member States and, on the external front, through the introduction of a common customs tariff and a common commercial policy. In fact, goods imported from third countries had to be treated in the same way by all Member States in order to circulate freely in the customs union. But the customs union itself had to be integrated into the existing international economic order, regulated by the 1948 General Agreement on Tariffs and Trade. On the EEC Treaty the Member States declared that in creating a customs union, they intended to contribute, in accordance with the common interest, to a harmonious development of world trade, a gradual removal of restrictions to international trade and the lowering of customs barriers. The creation of the customs union has led to strong growth in intra-Community trade, but the Community has not become insolated. Instead, it has developed into the world's biggest importer and exporter. In addition, the rules of the GATT and the various international agreements created under their influence, formed the legal basis for the EU's own commercial policy instruments and action, notably in the field of tariffs, the application of safeguard measures, anti-dumping and anti-subsidies actions. The European Union can introduce surveillance and safeguard measures in the framework of the common rules for imports when imports at prices viewed as normal are causing or risk causing serious injury to European producers. In cases where the export price is lower than the normal value of a like product (dumping), the EU can take trade protection measures, notably through the application of anti-dumping duties. European rules being compatible with those of the World Trade Organization, economic operators must comply with only one set of rules for imports into the EU These rules apply automatically in the new States acceding to the EU. At the same time, the common commercial policy facilitates the work of European importers who can use a uniform import license, valid throughout the EU. Protecting the Community from unfair and illegal trade while supporting legitimate business activity;c. Ensuring the security and safety of the Community and its residents, and protection of the environment, where appropriate in close cooperation with other authorities;d. Maintaining a proper balance between customs controls and facilitation of legitimate trade. The two faces of customsCustoms services in the EU play a dual role. Customs officers still act as collectors of customs levying import duties and taxes but increasingly they also work as â€Å"watchdogs† securing the Union’s external borders to protect citizens’ health and safety. Checks to enforce security and safety rules can only be performed at the EU’s external borders. It is inevitable that certain cargo shipments, which could pose a risk to the safety or security of the EU and its citizens, must be stopped and checked. These checks are different from the task of levying import duties, which customs authorities can perform at a later stage along the supply chain, for example on the premises of the importer or exporter, to avoid congestion at the EU’s external borders. The watchdogBorder checks to guarantee the safety and security of European citizens are performed by customs officers in close cooperation with other border agencies, such as veterinary and product safety authorities. Two particular causes of concern for customs authorities with respect to health and safety are counterfeit goods and drug precursors. The common customs tariff (CCT) adopted by the European institutions in 1968 is, therefore, a major achievement of European integration (Article 28 TFEU, ex Article 23 TEC). For the member countries, the CCT meant both the loss of customs revenue, which, since 1975, has been a resource of the Community/Union budget, and the option of carrying out an independent customs or trade policy. No member country can unilaterally decide on or negotiate tariff matters; all changes to the CCT are decided by the Council following negotiation (if necessary) and proposal by the Commission. All bilateral (between the EU and non-member countries) and multilateral negotiations are carried out by the Commission. As of 1968, the Member States are not entitled to unilaterally carry out customs policy, i. e. suspend customs duties or change CCT. Only the Council can waive the normal application of CCT by means of regulations adopting various tariff measures. Such measures, whether required under agreements or introduced unilaterally, involve reductions in customs duties or zero-rating in respect of some or all imports of a given product in the territory of the European Union. They take the form of EU tariff quotas, tariff ceilings or total or partial suspension of duties. Modernized Customs Code: Customs authorities today, faced with this rapidly changing and challenging environment, must ensure that they continue to provide a first-class service to EU citizens and companies. A central pillar of the MCC is the concept of centralized clearance, which makes it possible for authorized EU traders to declare goods electronically and pay their customs duties and value-added tax (VAT) at the place where their business is established, irrespective of the member state where the goods are presented. Centralized clearance builds upon the current practice of Single Authorization for Simplified Procedures. The current draft of the MCCIP, however, requires that traders send the required customs clearance information to multiple member states. Basically, where the customs office designated for the lodging of customs declarations (i. e. , supervising customs office) is in a different member state than the customs office that receives the physical goods (i. e. customs office of presentation/importation), the importer must provide the entry information to the customs offices in both member states as well as the member state where the VAT is due. The modernisation and simplification of the customs legal and technological environment started several years ago with a major amendment to the Community Customs Code adopted in 2005, which gave EU customs authorities the powers to implement some of the most advanced security requirements in the world, while creating an environment that does not disrupt legitimate trade. This amendment is expected to be fully mplemented by mid 2016. The Modernized Customs Code will, when fully implemented, provide the necessary simplifications to make customs and trade work better, faster and cheaper. The Electronic Customs Decision already provides a significant step forward in linking national customs Information and Communication Technology systems, benefiting both customs and trade. By meeting the needs of modern logistics, a pan-European electronic customs will increase the competitiveness of companies doing business in Europe, reduce compliance costs and improve security at the EU borders. The proposal to amend the mutual administrative assistance provisions in customs matters will streamline and improve the current IT systems and enhance capacity in the fight against fraud in the customs sector. These are important legal and technological steps that will prepare European customs both for the immediate and the medium term future. Electronic Customs are a significant development for the E. U. Though Damon wanted to die alone, I had unfinished business to attend to. I made my way from the quarry and began to walk back to the estate. The woods smelled like smoke, and the leaves were starting to turn. They crunched under the worn boots I had on my feet, and I remembered all the times Damon and I had played hide-and-seek as children. I wondered if he had any regrets, or if he felt as empty as I did. I wondered if we'd see each other in Heaven, being as we were. I walked toward the house. The carriage house was charred and burned, its beams exposed like a skeleton. Several of the statues around the labyrinth were broken, and torches and debris littered the once-lush lawn. But the porch light at the main house was on, and a buggy stood at attention beneath the portico. I walked around the back and heard voices coming from the porch. Immediately, I dove under the hedges. Hidden by the leaves, I crawled on my hands and knees against the wall until I came to the bay window that looked into the porch. Peering in, I made out the shadow of my father. A single candle cast weak beams of light around the room, and I noticed that Alfred wasn't in his normal spot sitting at the door, ready to instantly greet guests. I wondered if any of the servants had been killed. â€Å"More brandy, Jonathan? Laced with vervain. In Amnesty International’s article entitled, â€Å"Americas: Indigenous people at high risk of human rights violations† , it highlighted the laudable attempt of ten countries in the Americas to protect the rights of their indigenous peoples. In one way or another, our lives can be traced back to the indigenous peoples. Hence, any step taken in order to eliminate the dangers that they face is matter that concerns all of us. The discrimination of indigenous peoples may be rooted in other people’s hunger for power and domination. As the article states, indigenous peoples are subjected to various attacks against their safety and honor. The native tribes in the Americas, such as the Pemon indigenous community, and the Embera-Katio communities of Cordoba, are being used and abused by armed groups such as the paramilitaries in order to fulfill their selfish objectives. In a sense, these indigenous peoples are treated like objects that other people can just use to their advantage, without regard for their dignity and humanity. While development and progress are not bad in themselves, they can be the tools that people may use to justify their violence and disrespect for the lives of indigenous peoples. This is what the article by Amnesty International seeks to prevent, by encouraging governments of countries in the Americas to pursue measures in order to enforce laws protecting the rights of indigenous peoples. Amnesty International recognizes that despite the existence of laws protecting the rights of indigenous peoples in the Americas, these are still insufficient without aid of proper and effective enforcement measures. What might be needed in order to achieve this goal of safeguarding the lives of the tribal communities is the political will of governments in order to pursue such measures. This is due to the fact that if there is actually no will on the part of the executive to ensure the application of enacted laws, all actions by the legislative branch of the government will only be put to naught. Hence, protective laws will only be mere scraps of paper. While the article is informative insofar as giving an introduction about the various occurrences of indigenous peoples-directed discrimination, it does not go as far as enlightening the reader as to the actual content of the Indigenous and Tribal Peoples Convention, or Convention 169, which was adopted on 27 June 1989 at the General Conference of the International Labor Organization. This treaty was the background used by the article in talking about the indigenous peoples of the Americas and their current situation. However, the content such treaty was not discussed, and it is not clear whether the occurrences illustrated in the article may actually be prevented by the provisions of the convention. In sum, the article seems like a mere survey of the violations of indigenous peoples’ rights that are taking place in the different countries in the Americas. While it may be a good introduction, it lacks content worthy of a thorough analysis of the issue at hand. It would have been more useful if it also discussed the steps taken by the individual governments of the Americas or by the region as a whole in making sure that the enforcement measures are put into place and made effective. The reader would have also been more informed of the situation of the tribal communities if a brief background of each was given. In any case, the article on indigenous peoples was intriguing and engaging enough for the reader, and might even prompt a search for other materials on the subject. Perhaps the reader may be encouraged to read further on challenging impunity, which it describes as â€Å"one of the crucial steps† which must be taken by governments in the Americas if they are serious about protecting the rights of indigenous peoples. Ethics help people in getting a clear understanding of what is considered antisocial. They make up an invisible rule book that sets conditions as to what one should and shouldn’t do; it is a universally accepted scheme of behavior and allowances. Morals are the characters or conducts that are considered good or evil. Ethical morality means adhering to what is right and avoiding the things that are usually considered unacceptable. Morals and ethics help one become a better human and are a boon in most ways they are taught to all children from a young age and anyone that doesn’t imbibe them is frowned upon and avoided. Our classification of actions into ethical, justifies acceptable and unethical, unacceptable and classifications unlawful constraints and obstructs the growth of science and art and act as a bane in many ways. To further emphasize these â€Å"ethics certain activities are given harsh names. For example painting of public property, commonly called graffiti, is considered vandalism. Not only does it add art and color to normal uninteresting placed but it also expresses the thoughts of the citizens ,many times it depicts the past history and major events, it gives a deeper view and also a chance for unclaimed artists to express themselves and showcase their capabilities. If people would stop judging vandalism they would see the hidden beauty and talent. Doing research on animals is very often tagged as â€Å"abusing† the animals, when they are merely being used for experiments to gain more knowledge about them. In the time of Michelangelo, his paintings were first disapproved due to the nudity. People’s ideals against nudity in drawings cause them to turn blind towards the beauty and the feelings expressed in it. They realized that he was paying his models which were mainly prostitutes and as they considered prostitution sinful, according to them his usage of them as his muse and paying them to pose naked meant his paintings would be having the figures of prostitutes which would corrupt them; this mindset caused him to face many problems in his earlier days. His paintings had major difficulties and being sold, he almost gave up painting due to this, had he done so the Sistine Chapel may never be as famous and honored as it is today. Ethics almost shadowed an artist into giving up his pleasure due to the hardships and disapproval they aroused. His sculptures too were considered evil in the beginning as they expressed holy scenes in a different way and interpreted the Bible differently and unusually unlike the traditional method. His first Madonna and Son was highly insulted while it was still in the process of being made because it was nothing like how the usual sculptures were, but his unusualness and due to breaking the rules of tradition hat bound him, he is now known as a world famous sculptor of the David and his Madonna and Child sculptures are well renowned. The field of science requires people to be broadminded and willing to take risks. To be able to invent and discover new things scientists require people to be open to new methods of experimenting. To explore the world of science is t break the boundaries of ethic, logic and common things. It is to have a vision and find method to prove it. It requires making theories and looking for ways to prove them. To make discoveries one needs to break away from the commonly accepted beliefs and methods. Thus it is important for the scientists to not be bound by ethics and morals, to progress in the field and provide more accurate and newer information they need to be able to experiment in any way they please without having to seek acceptance. In Michelangelo’s time post mortems of bodies was illegal and one could be arrested and executed for the same. He was determined and had to hide and cut up bodies to explore them and see the organs. He was probably amongst the first people to hold a heart and brain in his hand. It was against the law and unethical but it was necessary for him to do so to make his sculptures more realistic and authentic. His breaking this ethical law resulted in his growth of knowledge about the human body. He was able to make much superior sculpture once he was able to determine the organs in the body as they helped him give the correct volume and dimension of the body. His discovery expanded his knowledge in science would not have been possible due to the ethical conduct of that era, and he would have never got to explore the human system had he not broken this conduct. Science and art can progress much further if they are not limited by ethics and morals, certain things must be excused from the usual norms of society as that will be the only way that we will have any progression or there could be mere stagnation in the fields of art and science. Artists must be allowed to break the barriers of ethics and express themselves freely as their works are mainly a source of reflection of today’s society. Science on the other hand requires a certain amount of freedom and exclusion from the usual ethical norms of society, for science to progress and discoveries to be made, certain allowances and concessions must be given. For humans to know and understand animals better they must be allowed to conduct experiments and study them to decipher their thought process and lifestyle and to understand their reactions and behavior to certain situations. Science must be free from the tethers of human morals and ethics and it must not be judged and obstructed. Limiting and restraining the field of science will only cause us to be ignorant and uninformed about the world. Ethics are needed to provide a certain safety and to an extent, a united environment without controversies, but it must not interfere with the progress of humanity and studies. It would only cause problems in the future, and if not causing problems it would definitely not do anything worthwhile n contributiong towards providing the solutions.

The Development of Education Policy in Malaysia Towards the end of British colonialism era, a movement was created by the society including several group of educated Malay in restoring our colonial education system. The first Minister of Education and the second Prime Minister of Malaysia, Tun Abdul Razak led a special committee to make some recommendations. This comprehensive proposal was known as Razaks Report 1956 that was to create a national education system to uphold the cultural, social, economic and political development such as make the Malay language to be the national language and primary mode of instruction in the system. To establish Education Ordinance 1957, the idea of the Razaks Report became the basic feature. Besides, the government of Malaysia started to create several progressive changes especially of the curriculum in order to endeavour the Malaysian outlook. In 1960, a new special committee was recruited to create the Rahman Talibs report in order to review and analyze the education policy which then became the basic feature in the establishment of the Education Act 1961. The national language was made compulsory subject in primary and secondary schools and in all training institutions by the Education Act 1961. This act also provide that a satisfactory grade must be achieved by the students in order to receive the certificate for public education examination particularly for the lower and upper secondary levels. Mahathirs Report which was chaired by Tun Dr Mahathir Mohammad, who was the Education Minister at that time (later become the Prime Minister since 1981) was provided in 1979 by a sp ecial committee which after a six-year study, was then finalized. This report achieves national unity in a multiethnic society, enhancing the patriotic spirit, and generates skilled manpower for the development of nation in order to inspire a balance in every single aspects of education between rural and urban areas. In recent years, the guidelines in reforming the education system has been based on this report. Major changes in Education Policy of Malaysia As mentioned in the 46th ICE country report these regulatory frameworks were formulated and revised in line with the government policy of democratization of education. Five of the acts, namely The Private Higher Educational Institutions Act 1996, The National Council on Higher Education Act 1996, The National Accreditation Board Act 1996, The Universities and University Colleges (Amendment) Act, 1996 and The National Higher education Fund Board Act 1997. The education Act 1996 has some major changes in its regulation for the primary and secondary education has been reviewed for amendment by the Ministry of Education. The implementation of compulsory education at primary school level is the main purpose of reviewing this act. The Education Act 1996 was amended again in 2002 and 2003. This policy makes sure that every child in Malaysia beginning at age 6, regardless of sex, social and economic background, and residential locality has the right to primary education. For example, the delivery of mathematics and science subjects has always been in the National Language (Malay) called MBMMBI (Policy for Upholding the Malay Language, Strengthening the Command of English) in Malaysia. However, English language was made the medium of instruction for both of these subjects in 2002. Based on the rationale, a good command of English would enable students to access the internet and read articles published in English. However, the teaching and learning of science and mathematics which reverts to Malay language in national schools will become effective soon. The implementation of this latest policy of using teaching the two  subjects in Malay language in  Year One and Year Four in the primary school and Form one and Form Four in the secondary school shall start in 2012. Deputy Prime Minister Tan Sri Muhyiddin Yassin, also the Education Minister said these two subjects in Chinese and Tamil national-type schools would be carried out in mother tongue respe ctively. Then, the cabinet today approved by empowering the Malay language and strengthening the teaching and learning of the English language at all levels of schooling. However, this change would not affect Form Six and matriculation students. Furthermore, another policy comes out with history will be a must- pass subject in Sijil Pelajaran Malaysia (SPM) examination from 2013 along with the Bahasa Malaysia subject to enlighten the understanding of Constitution on nation- building process of our country. The Development of Education Policy in the United Kingdom In the year of 1870, elementary education fully paid by the government was introduced in England. After the elementary education stage, 80% of the students left school, which after 1918 finished at 14. Free secondary education was introduced in the 1944 Education Act. From here we can see that the UK education policy maker has a different aim. The main overall principle approach was pursuance of equality. Non-selective or comprehensive schools were introduced progressively. However, in 1960, the comprehensive education became the policy of the government. These comprehensive educations can help to improve the prospects of children of average ability by reducing the discrimination or disadvantage on the basis of class. With the idea of equality and opportunity, the selective system becomes more dependable. Comparing to students that go to comprehensive schools, the working class students that went to grammar schools did much better in their education. Market Reforms In the 1980s and 1990s, successive Conservative governments increased the pace of reform and introduced so called market mechanisms. This mechanism in the UK education system can force schools to raise their standards. The 1988 Education Reform Act notices about a quasi-market in education which introduced the market reforms and also the National Curriculum described in Section 3. Thus, there were widespread fear about poor and falling standard in education of UK about the concerns on widening access and educational in equality in 1980s since too many individuals leaving school too early with little basic skills. The aim of the package of market-oriented reforms is increasing parental choice and improving the accountability of state funded schools. Parents could choose which school their child attended. Regard to student enrolment numbers to give schools the incentive to attract and admit more students, school funding became more closely to be linked. Some schools could take control of their own budgets or directly from central government which is opposed to being under local government control. Curriculum Reform UK introduced two other significant national policies to tackle the problem of poor literacy and numeracy. Firstly, in the late 1980s a standardized national curriculum was introduced for pupils aged between 7 and 16. The aim was to raise standards by ensuring that all students study a prescribed set of subjects up to a minimum level until the age of 16. The second policy reform, in 1998, was e National Literacy and Numeracy Strategies that involve all primary schools to allocate part of the daily curriculum to literacy so the pupils basic skills are developed. For the attempts to raise participation in post-compulsory schooling in the UK, there are two major policies. The first is the perennial (and often ineffectual) attempts at qualification reform, which enhances the attractiveness and labour market value of vocational qualifications. Moreover, the second policy was Education Maintenance Allowance, which paid a small means-tested allowance to individuals from disadvantaged backgrounds since they stayed on in full time education beyond the age of 16. Chicago’s Cabrini-Green public housing project is notorious in the United States for being the most impoverished and crime-ridden public housing development ever established. Originally established as inexpensive housing in the 1940’s, it soon became a vast complex of unsightly concrete low and high-rise apartment structures. Originally touted as a giant step forward in the development of public housing, it quickly changed from a racially and economically diverse housing complex to a predominantly black, extremely poor ghetto. As it was left to rot, so to speak, Cabrini-Green harbored drug dealers, gangs and prostitution. It continued its downward spiral of despair until the mid 1990’s when the Federal Government assumed control the Chicago Housing Authority, the organization responsible for this abomination. Cabrini-Green has slowly been recovering from its dismal state of affairs recently, with developers building mixed-income and subsidized housing. The Chica go Housing Authority has also been demolishing the monolithic concrete high-rise slums, replacing them with public housing aimed at not repeating the mistakes of the past. Fortunately, a new era of public housing has dawned from the mistakes that were made, and the lessons that were learned from the things that went on for half a century in Cabrini-Green. In 1942, a public housing development went up on Chicago’s near north side to house veterans returning from World War II. They were known as the Francis Cabrini Homes, and â€Å"were built in an area that had undergone massive slum clearance†.
